Heard the learned counsel for the petitioners, learned counsel for the respondent State and the learned counsel for the respondent no.1/Union of India.
The prayer in this petition has been made for quashing of the order dated 05.04.2024 issued by the Assistant Executive (HRM and Estate), Hindustan Steel Works Construction Limited for vacation of Quarter No.D-3 allotted to the petitioner vide lease agreement dated 07.03.2019.
Mr. Abhay Kumar Mishra, the learned counsel for the petitioners submits that the petitioners were provided the said quarter on lease and in view of extension of Bokaro Airport, the said land was transferred by M/s Bokaro Steel Plant to Union of India for extension of the Airport. He submits that in view of letter dated 23.02.2008 the intimation was also made to the occupants that the decision has been taken to dismantle T-20 type of houses and as soon alternative arrangement will be made the concerned persons have to vacate the quarters in question. He submits that without making alternative arrangement, the petitioners have been forced to vacate the quarter in question. He submits that the petitioners have also filed the representation before the management of Hindustan Steel Works Construction Limited (HSWCL).
The learned counsel for the respondent State draws the attention of the Court to the letter dated 05.04.2024 whereby the petitioners have been intimated that the lease has already been expired on 30.09.2019, but still they are occupying the house in absence of any extension and further they have narrated to clear all the dues and vacate the quarter in question.
In view of above, it is crystal clear that the lease agreement is already expired and that has not been extended as yet and no right further has accrued in favour of the petitioners, however, the petitioners may approach the competent authority of Hindustan Steel Works Construction Limited for such prayer which can be considered sympathetically by the concerned authority of Hindustan Steel Works Construction Limited.
W.P.(C) No.3166 of 2024 is accordingly disposed of.
Pending petition if any also stands disposed of accordingly.
