Learned counsel for the appellant submits that the alleged occurrence was said to be occurred on 28.8.2024 and the F.I.R was lodged on 24.9.2024. he further submits that this appellant has filed a case against the respondent no.2 being Lohardaga P.S. Case No.170 of 2024 for the same date of incidence earlier and thereafter the present case is lodged maliciously. He submits that the allegation is general and omnibus.
Issue notice upon the respondent no.2 by registered post with A/d as well as under ordinary process for which requisites etc must be filed within a week.
It was pointed out that arising out of same F.I.R, one Cr.Appeal (SJ) No.779 of 2024 is pending and is coming on 13.02.2025.
Let this appeal be tagged with Cr.Appeal (SJ) No.779 of 2024.
Since the interim protection is provided in that appeal, the same order is being passed, and till the next date, no coercive steps shall be taken against the appellant in connection with Lohardaga SC/ST P.S. Case No.15 of 2024, pending in the court of learned Additional Sessions Judge-I- cum-Special Judge, SC/ST (POA) Act, Lohardaga.
