Judgment

This matter is taken up through hybrid arrangement (virtual/physical mode).
This the second journey of the Petitoiner, who is in custody in connection with Phulbani Town P.S. Case No.194 of 2018 corresponding to C.T.
Case No.46 of 2018 on the file of learned Additional Sessions Judge-cum-Special Judge, Phulbani, Kandhamal running for commission of offence
under sections 457/395/398/201/120-B/506 of the IPC read with section 25/27 of the Arms Act and 20(b)(i)(c)/29 of the NDPS, in filing this
application under section 439 of the Cr.P.C., has prayed for his released on bail.
Heard learned counsel for the Petitioner and learned counsel for the State. Gone through the materials as placed.
Considering the submissions made; further keeping in view the material materials on record as those stand against the Petitioner with other
surrounding circumstances including factum of release of co-accused persons on bail by the orders passed by this Court in BLAPL Nos.6606, 6674,
6714 of 2019 and BLAPL No.8693 of 2021 as also the detention of the Petitioner in custody, being inclined to reconsider the prayer for grant of bail to
the Petitioner, it is directed that the Petitioner be released on bail in the aforesaid case on such terms and conditions as deemed just and proper by the
court in seisin of the case.
The BLAPL is accordingly disposed of.
Issue urgent certified copy of this order as per rules.
