This matter is taken up through Hybrid arrangement (video conferencing/physical mode).
Heard Mr. Uma Shankar Patel, learned counsel for the petitioner appears through Virtual High Court at Sundargarh district and Mr. Rajesh Tripathy, learned Additional Standing Counsel for the State of Odisha.
This is an application under section 439 of Cr.P.C. in connection with G.R. Case No.108 of 2023 arising out of Rajgangpur P.S. Case No.76 of 2023 pending in the Court of learned J.M.F.C., Rajgangpur for offences punishable under sections 457/395 of the Indian Penal Code read with sections 25/27 of the Arms Act.
The prayer for bail of the petitioner was rejected by the learned Sessions Judge, Sundargarh vide order dated 14.03.2023.
Considering the submission made by the learned counsel for the petitioner that the petitioner is in judicial custody since 20.02.2023 and the accusation against the petitioner is one under section 412 of the Indian Penal Code and some of the co-accused persons have already been released on bail and on hearing the learned counsel for the State, I am inclined to release the petitioner on bail.
Let the petitioner be released on bail in the aforesaid case on furnishing a bail bond of Rs.50,000/-(rupees fifty thousand) with two local solvent sureties each for the like amount to the satisfaction of the learned Court in seisin over the matter with further conditions as the learned Court may deem just and proper.
Accordingly, the BLAPL is disposed of.
Urgent certified copy of this order be granted on proper application.
