This Criminal Petition has been filed by the petitioners/accused Nos.12, 13 and 15 seeking a direction to the learned Principal Senior Civil Judge-cum-Assistant Sessions Judge at Hanamkonda (designated Special Court for the trial of CBCID Cases), to conclude the trial and disposal of C.C.No.5 of 2018 (Old Case No. C.C.No.210 of 2011) by fixing time limit.

Heard Mr. N.Ananda Rao, learned counsel for the petitioners, and Mr. Jithender Rao Veeramalla, learned Additional Public Prosecutor for respondent No.1-State.

Notice in respect of respondent Nos.2 to 4 is dispensed with on the ground that the petitioners are not seeking any relief against them and they are only seeking a direction to the learned trial Court for expeditious disposal of C.C.No.5 of 2018.

Learned counsel for the petitioners submitted that the Investigating Officer filed final report as long as in the year 2010 and the same was took cognizance and numbered as C.C.No.210 of 2011 and it was renumbered as C.C.No.5 of 2018 and since 2011, the matter is pending before the trial Court. He further submitted that on behalf of prosecution, most of the prosecution witnesses were already examined and the matter before the trial Court is posted for examination of panchas and Investigating Officers. However, the trial Court adjourning the matter from time to time without assigning any reasons much less valid reasons. He further submitted that the petitioners/accused Nos.12, 13 and 15 are senior citizens. Unless this Court fixes a time limit for the conclusion of the trial and disposal of C.C.No.5 of 2018, the petitioners will be put to great hardship. He also submitted that, except the present case, no other old cases are pending.

Taking into consideration the peculiar facts and circumstances of the case, age of the petitioners and the submissions made by the learned counsel for the petitioners, the trial Court is directed to conclude the trial and dispose of the C.C.No.5 of 2018 in accordance with law, as expeditiously as possible, preferably within a period of six (6) months from the date of receipt of a copy of this order. It is needless to mention that the parties in lis are directed to cooperate with the trial Court without seeking undue adjournment.

With the above said direction, the Criminal Petition is disposed of accordingly.

Miscellaneous applications, pending if any, shall stand closed.
