This present petition has been filed under Article 226 of the Constitution of India seeking to transfer the petitioner from Elmara High School, Silachari, Korbook, Gomati Tripura to any school at Agartala on nearby Agartala within a travelable distance/radius of 30 Kms from his permanent residence/home town on humanitarian consideration as well as in pursuance to the notification vide No.F.23(39)-GA/(P&T)/2021 dated 15.11.2021.
Ms. R. Purukayastha, learned counsel appearing for the petitioner submits that his case of transfer may be considered on humanitarian grounds that the wife of the petitioner is severely ill.
Heard and perused the evidence on record.
It is seen from the record that on 24.01.2023, the petitioner filed a written representation before respondent No.2 through proper channel along with all medical documents. On 09.03.2023, respondent No.4 forwarded his application to respondent No.2. On 11.05.2023, respondent No.5 again forwarded the application for transfer of the petitioner to respondent No.2. But the respondents till date, had not considered the same.
As such, without expressing any opinion on its merit, this present writ petition is disposed of with a direction upon the respondents to consider the case of the petitioner in the light of the transfer scheme of the Government within a period of 3(three) months from the date of receipt of the copy of this order.
With the above observation and direction, this present writ petition stands disposed of. Stay if any stands vacated. Pending application(s), if any also stand closed.
