Heard Ms. A. Debbarma, learned counsel appearing for the petitioner. Also heard Mr. P. Gautam, learned counsel appearing for the respondents-State.

The petitioner has filed the present writ petition challenging the order of transfer dated 17.01.2024 issued by the Director Elementary Education, Government of Tripura whereby and whereunder he has been transferred from Vivekananda Vidyamandir High School(Pry), Sadar, West Tripura to Dayaramkami High School(Pry), Raishyabari, Gandatwisa, Dhalai, Tripura.

The petitioner is a school teacher.

Ms. Debbarma, learned counsel for the petitioner has submitted that the petitioner has been suffering from various ailments and due to his present health condition it would not be beneficial for him to join at a school at Raishyabari, which is a very remote area where there is no adequate medical facilities. Only on this limited ground, the petitioner has challenged the impugned order of transfer urging this Court to consider his representation as it has not been considered till today by the respondents.

Mr. Gautam, learned counsel for the respondents-State has submitted that transfer is an incident of service and the transfer of the petitioner has been made in the interest of public because the school where he has been transferred lacks adequate number of teachers.

I have considered the submissions of learned counsel appearing for the parties.

Since the petitioner has been suffering from illness, the respondents-State may consider to ask the petitioner to appear before the recognized Medical Board, Government of Tripura and thereafter considering the seriousness of his health condition may dispose of the representation of the petitioner within a period of 2(two) weeks from today.

With the aforesaid observations and directions, the instant writ petition stands disposed.
