Petitioner Smt. Rajo is involved in a criminal case under section 306/34 of the Indian Penal Code registered vide FIR No. 119 G.R.P. Jind. The prayer made in this application is that the petitioner be released on interim bail as her husband Balwan Singh who is also an accused in the aforesaid case has been operated for cancer and he requires one attendant with him.
On notice of the application being issued, learned AAG Haryana has put in appearance.
Learned counsel appearing for the State could not dispute that Balwan Singh husband of the petitioner has been suffering from cancer and he has been operated for that discase. It is also not disputed that said Balwan Singh has been released on interim bail upto 13.1.1996. Learned AAG Haryana however, submitted that somebody else could attend on Balwan Singh, the husband of the petitioner.
On a consideration of the matter, I am of the view that it is a fit case for granting interim bail to the petitioner. Accordingly, it is ordered that the petitioner shall be released on interim bail uptill 13.1.1996 on her furnishing personal bond in the sum of Rs. 10,000/ with one surety in the like amount to the satisfaction of the Chief Judicial Magistrate/Duty Magistrate, Jind. It is further ordered that the petitioner shall surrender herself before the jail authorities on the expiry of period of interim bail granted herein.
Crl. Misc. stands disposed of accordingly.
