The petitioner has filed this 'Public Interest Litigation' questioning the order passed by the State authorities to allot the subject work to respondent

No.4. The issue pertains to request for proposal for operation and management of Hearses (Shav Vahan) in the State of Chhattisgarh.

It is argued that the RFP provides that Hearse Unit will have to be fabricated on Tata Venture or equivalent chassis. The fabrication design for the

cabin should provide space for the following :

• Seating arrangement on one side

• Elevated platform for placing the dead body with stretcher locks.

However, the agreement executed between respondent No.2 and respondent No.4 allowed Tata Ace and MarutiEecoor vehicles for putting

fabrication of the Hearse Unit, which is not permissible because Tata Ace and MarutiEcoor are commercial vehicles.

It is not for the petitioner to dictate as to which vehicle is to be used for fabricating the Hearse Unit. The RFP provides that Tata Venture or

equivalent chassis can be used for fabrication of Hearse Unit.

There is no difference if the dead body is taken either in Tata Venture or in Tata Ace or MarutiEecoor, if it satisfies and has the necessary

arrangements as specified in the RFP.

The present WP(PIL) is not espousing any public cause. Therefore, the petition has no substance and it deserves to be and is hereby dismissed.
