At the outset, learned Senior Advocate Mr. Rajesh Kumar Singh, submits at the Bar that the defects, as pointed out by the stamp reporter, regarding filing of the Letter as contained in Memo No. 4221 dated 18.02.2006, as mentioned in paragraph 1(b) of the writ application, has no relevance in adjudication of the issue involved in the present writ petition and, as such, he submits that he will not place any reliance over the said letter.

Learned Advocates for the State and University have no objection.

The defects as pointed out by the stamp reporter stands ignored, for the present.

Though the matter is placed under the heading "For Order on Office Notes", however, the grievance of the petitioner is in limited bound to the extent that he seeks a direction upon the respondents authority to release and disburse the outstanding arrears of difference of the salary of the petitioner forthwith for the period from May 2006 till date. For redressal of the grievance, the petitioner has also filed a detailed representation before the Finance Officer, Magadh University at Bodh Gaya on 12.07.2025.

Learned Advocate for the Universities, however, in order to apprise this Court with regard to the present position prays for a short adjournment.

Considering the submissions advanced and the materials available on record, especially the relief sought for in the writ petition, this Court deems it fit and proper to dispose off the writ petition with a direction to the petitioner to file a fresh representation along with the copy of this order before the Finance Officer, Magadh University at Bodh Gaya, preferably within a period of four weeks from today.

In case, such a representation is filed, the same shall be considered and bring to its logical conclusion, preferably within a further period of eight weeks.

It is made clear that if the claim of the petitioner finds merit, the outstanding arrears of difference of salary must be paid forthwith. However, in case, there would be any legal or administrative impediment, the authorities shall be obliged to pass a reasoned and speaking order.
