Order dated 30.07.2020 as well as order dated 27.11.2018 passed by the Munsiff, Samba and Sessions Court, Samba respectively have been impugned in this petition. The Trial Court vide order dated 30.07.2018 has dismissed the application filed under Section 540 Code of Criminal Procedure for recalling of the prosecution witnesses. The said order was upheld by the learned Sessions Judge, Samba vide order dated 27.11.2018.
During the pendency of the instant petition, vide judgment dated 04.07.2020 passed in the case, titled, State vs. Mohd Yousuf and others, arising out of FIR No. 15/2010 of Police Station, Vijaypur for commission of offences under Sections 336/323/325/447/427/34 RPC, the trial has culminated into the acquittal of the accused persons, who are respondent Nos. 1 to 4 in the instant petition.
In view of the above, nothing survives for consideration in this petition. The same is, as such, dismissed for having become infructuous along with connected IA.
