In the instant OA, the applicant is seeking family pension as his wife who was serving, had unfortunate expired on 4.2.2002 while in service. It took some time before the applicant could apply for such retiral benefits, due to acquittal of the applicant, by way of judgement by the competent Court case on 21.12.2011. Thereafter, the papers for retiral benefits were submitted. Papers had since been processed for the same.
Some other objections raised by office, have since been cleared by applicant. However, the Pay and Accounts Office has now raised some other objection on 28.09.2020 and the respondents pleaded that the applicant had taken it by hand to clear the same. The applicant's counsel is not aware about this latest development of 28.09.2020.
Matter has been Heard. The Tribunal notes that action for the grievance raised in this OA, i.e. release of retiral benefits, is already under way and unless the formalities are completed the same cannot be released. Therefore, the Tribunal finds that no useful purpose will be served by keeping the OA pending.
Therefore, the instant OA is disposed of with direction to the applicant, to clear with the objections at the earliest and allow some reasonable time thereafter, say three months, to respondents to issue orders for release of retiral dues including arrears, if any. The applicant shall have liberty to approach the Tribunal, if his grievance still subsists. No costs.
