Judgment
Heard the learned counsel for the applicant, learned counsel for the respondents and perused the records.
Through this O.A., applicant has prayed for the following relief(s):-
“1.To quash the impugned order dated 16.06.2020 & 29.07.2020, contained as Annexure No.A-1 & A-2 to this OA, with all consequential benefits.
2.To fix the pensionary benefits considering Grade Pay Rs.4800/- and release the difference alongwith interest @12% per annum from the date of due till the actual date of payment.
3.To direct the respondents not to impose any kind of recovery and recovered amount if any, may be refunded along with interest @12 p.a. from the date of due till the actual date of payment.
4.Any other relief, which this Hon'ble Tribunal may deem fit, just and proper under the circumstances of the case, may also be passed.
5.Cost of the present case as the applicant has unnecessarily been dragged in litigation."
At the outset, learned counsel for the applicant argued that grievances of the applicant have been redressed by the respondents except delayed payment of DCRG of Rs. 3,10,158/- for which applicant is entitled for interest.
Learned counsel for the respondents opposed the aforesaid submissions, however, conceded the fact that grievances of the applicant have been redressed by the Department. Further argued that Department rectified its mistake and paid the DCRG of Rs. 3,10,158/- on 02.01.2026.
Respondents have filed evidence of disbursement of DCRG as CR-2 of the counter reply which runs as follows:
“कार्यालय, वरिष्ठ मण्डल वित्त प्रबन्धक, उत्तर रेलवे, लखनऊ-226001 पत्रांक-पेंशन/विविध/आपति/2025/SMa दि०: 05-01-2026 मण्डल कार्मिक अधिकारी, (निपटान) उत्तर रेलवे, हजरतगंज, लखनऊ Court Case विषय: -Rajesh kumar Ex. CWMI/LKO, DOR-30.06.2020 (PPO-20207030600452) के recovered DCRG बिल भुगतान के विषय में। संदर्भ: -In reference OA No. 198/2020 titled as Rajesh Kumar s/o Lt. Sankata Prasad was filed before Hon'ble CAT/LKO and granted MACP vetted by accounts on 21/04/2025. उपरोक्त विषय के संबंध में अवगत करना है कि कर्मचारी के DCRG के बिल का संदर्भित पत्रांक व लेखा द्वारा vetted MACP के अनुपालन में रोकी गयी DCRG रु० 310158/- का भुगतान Pay Order (Bill No. 03062507817) के द्वारा CO7 Number: 03060925700231 Dtd:02/01/2026 के माध्यम से किया गया। सहायक मण्डल वित्त प्रबन्धक, उत्तर रेलवे, लखनऊ”
As per law, applicant being retired employee is entitled for interest from due date till the actual date of payment for delayed payment of DCRG.
In view of the above, respondents / competent authority is directed to pay the interest at the rate applicable on GPF under Rule 65 of CCS (Pension) Rules, 2021 with regard to delayed payment of DCRG of Rs. 3,10,158/- from due date till the actual disbursement date as per rules within two months from the date of receipt of certified copy of this order.
The OA is disposed of in the above terms.
There is no order as to costs.
Pending MAs, if any, also stand disposed of.
