Learned counsel for the parties are present.
Learned counsel for the petitioner has submitted that by the impugned proceeding and order, the petitioner has been imposed a minor punishment. He submits that the Authority while holding the petitioner guilty have travelled beyond the charge. He also submits that as per the charge, the petitioner had purchased certain material without any tender process and without calling for any quotation from anybody.
In response to the charges, it was stated that the person from whom the petitioner had purchased the material was already enlisted with the district industry center and he has also referred to paragraph 3 (v) (the portion of circular of the finance department) at page No. 54 of the writ petition to submit that if goods are to be purchased from enlisted person then there is no need to call for any tender process. However, during the course of argument, he sought adjournment to explain this court as to whether the enlistment in district industry center by itself would amount to enlistment of the person concerned with the department. He prays that the matter be posted on 08.12.2022.
