By Hon’ble Mr. Rajnish Kumar Rai, Member (Judicial)

Mr. Ashish Srivastava, learned counsel for the petitioners, and Mr. M.K. Sharma, learned counsel for the respondent, are present and heard.

2.

Learned counsel for the petitioners submitted that the order and direction passed by this Tribunal dated 03.04.2025, directing the respondents to call the petitioners for viva-voce for the post of AOM and declare the result, has been complied with. He submitted that the petitioners have been empanelled to the post of Chief AOM, Group ‘B’ Gazetted, under 30% LDCE. However, the respondents are yet to fix the seniority of the petitioners with effect from the date of empanelment, as has been done in the case of other similarly situated persons.

3.

Learned counsel for the respondents submitted that the order passed by this Tribunal has been duly complied with.

4.

Considering the submissions made by learned counsel for the petitioners and upon perusal of the order passed by this Tribunal, we are of the opinion that the direction of this Tribunal was limited to the extent of calling the petitioners for viva-voce examination, their appearance therein and declaration of the result. The said direction has been duly complied with. However, if the petitioners have any grievance with regard to fixation of their seniority, they are at liberty to approach the appropriate authority by making an appropriate application, if so advised.

5.

Accordingly, no case of civil contempt is made out. The contempt proceedings are, therefore, dropped and the notices issued to the respondents stand discharged.

6.

All pending M.As., if any, also stand disposed of. There shall be no order as to costs.
