Judgment
Per Hon’ble Mr. Justice Anil Kumar Ojha, Member-J
Heard the learned counsel for the applicant, learned counsel for the respondents and perused the records.
Through this O.A., Applicant has prayed for the following relief (s):-
“(i)To issue order or direction thereby the respondents be directed to consider the case of the applicant in accordance with the Railway Board Circular dated 20.5.1974 still subsisting and give appointment against the Group „D‟ post with the N.E. Railway, Lucknow within stipulated time.
(ii)To award the cost of the application.”
Through M.A. No. 2430 of 2026, applicant has prayed for early disposal the case.
At the outset, learned counsel for the applicant submitted that ends of justice would be served if applicant is permitted to file fresh representation stating all the facts and competent authority may be directed to decide the same by way of reasoned and speaking order within a stipulated period of time.
Learned counsel for the respondents orally opposed the aforesaid prayer, however, requested that at least eight weeks’ time may be given for disposal of the fresh representation.
Keeping in view, the innocuous prayer made by the applicant, this O.A. is disposed of finally, without going into the merits of the case, with a direction to the applicant to prefer fresh representation stating all the facts within two weeks from today and respondents/ competent authority shall consider and decide the said representation of the applicant within a period of eight weeks from the date of receipt of such representation in accordance with law by passing a reasoned and speaking order under intimation to the applicant forthwith.
There is no order as to costs.
Pending MAs, if any, also stand disposed of accordingly.
