In this Original Application, the issue of non-functioning/improper functioning of sewage treatment plants (STPs) at New Kondli, Mayur Vihar, Phase – III is under consideration. The Tribunal by the earlier order dated 29.05.2023 had directed Delhi Jal Board (DJB) and Delhi Pollution Control Committee (DPCC) to submit the factual and action taken report. The report so submitted by DJB and DPCC were considered by the Tribunal in the proceedings dated 30.10.2023 and the reports were found to be deficient. Hence, fresh reports from DJB and DPCC were called. The fresh reports were again considered by the Tribunal and they were not found to be satisfactory. Hence, the Tribunal by order dated 15.01.2024 had directed the Member Secretary, Central Pollution Control Board (CPCB) to carry out the sample analysis from Inlet and Outlet of all four STPs with reference to BOD, SS and FC and submit the report.

Now,  I.A  No.  104/2024  has  been  filed  under  the  signature  of Scientist ‘F’, CPCB with a prayer to consider carrying out the inspection and sampling of four STPs by a senior officer of Scientist ‘E’ level of CPCB followed by their analysis in laboratory and allow the Member Secretary, CPCB to nominate such senior officer.

We  find  that  in  the  peculiar  circumstances  noted  above  the Tribunal on 15.01.2024 had directed the Member Secretary, CPCB to get the sample analysis from the Inlet and Outlet of all the four STPs be done and submit the report. In the I.A No. 104/2024 no particular reason has been disclosed nor the I.A No.104/2024 has been filed by the Member Secretary, CPCB.

Hence, in the circumstances of the case we are not inclined to accept the prayer made in the I.A No. 104/2024.

I.A No. 104/2024 is rejected accordingly.

Let the needful in terms of the order dated 15.01.2024 be done by the Member Secretary, CPCB and the report be filed atleast one week before the next date of hearing.
