The applicants state that they are working as Superintendents in the GST & Central Excise, Ministry of Finance. According to them, they are entitled to be extended the benefit of Non Functional Upgradation (NFU) in the Grade Pay of Rs.5400/- on completion of four years of service in the Grade Pay of Rs.4800. They claim that they have made representations to the respondents in terms of the judgments rendered by the Hon'ble Madras High Court.

This OA is filed with a prayer to direct the respondents to extend the benefit of NFU and the Grade Pay of Rs.5400/- on completion of four years of service in the Grade Pay of Rs.4800/-.

We heard Shri Sanjay Kumar, learned counsel for the applicants and Shri R. S. Rana, learned counsel for the respondents.

The question as to whether the applicants are entitled to be granted the benefits of NFU, and whether there exists any precedent in this regard, needs to be examined by the respondents. We cannot decide the issue straightway. In view of the fact that the applicants have already made representations, we feel it appropriate to direct the respondents to pass orders on the representations made by the applicants.

We, therefore, dispose of the OA directing the respondents to pass orders on the representations made by the applicants claiming the benefit of NFU within a period of three months from the date of receipt of a copy of this order. There shall be no order as to costs.
