The petitioner has retired from service on 30/03/2019 and working under the respondent No. 2. The grievance raised by the petitioner is to an order of recovery passed by the department on 17/01/2019 and also for direction to release the retiral dues payable to the petitioner.
Prima facie, this Court is of the view that the writ petition may not be maintainable for the reason since the petitioner substantively is an employee of the co-operative society, the petitioner has an alternative statutory remedy of approaching the authorities under the Co- operatives Society Act under Section 55(2) for redressal of his grievance. Therefore, the writ petition for the said reason is not maintainable. However, it is directed that in case if the petitioner approaches the concerned Deputy Registrar having jurisdiction under Section 55(2) of the Co-operatives Society Act, the authorities in turn shall consider and decide the claim of the petitioner at the earliest.
With the aforesaid directions, the writ petition stands disposed off.
