Judgment
Learned Counsel for the Appellant has moved this Interlocutory Application (I.A. No. 791 of 2011) seeking modification of the order dated 23.11.2010 by which the Appellant was directed to publish the notice of the Respondent in daily newspaper "An and Bazar Patrika" or "Statesmans" published from Kolkata.
The total claim of the Appellant is Rs. 88,500/-and according to the Appellant the bill for publication of notice in these two newspapers is Rs. 65,000/-, therefore, the Appellant may be permitted to publish the notice either in "Bartmaan" or in "Yugantar" published from Kolkata.
In view of the above facts, the Appellant is permitted to publish the notice in "Bartmaan" daily newspaper published form Kolkata, at the cost of the Appellant, for which the process may be filed by the Appellant within a period of two weeks from today.
In addition to above, the Appellant is directed to make efforts for service of notice on Respondent Nos. 1 and 2, for which the learned Counsel for the Appellant may file requisites etc. in two sets, one be given to the learned Counsel for the Appellant as Dasti for sending it by registered post with A/D and another be sent through ordinary process. The Appellant is further directed to submit the receipt of registered post before this Court.
