Judgment
Grievance in this application is against nuisance of parks meant for general public. According to the applicant, the parks are being misused by holding private functions and in the course of such functions, garbage is dumped, generators and DG sets are used and unauthorized parking is done.
The Tribunal earlier passed orders dated 28.01.2021 and 16.07.2021 requiring remedial action by the statutory authorities including, Commissioner, North Delhi Municipal Corporation, Deputy Commissioner, North Delhi Municipal Corporation, Rohini Zone, Commissioner of Police, Delhi, the DCP, Outer District, Pitampura, Delhi and the DPCC. According to the applicant, violations are still being continued and the statutory regulators are not taking necessary action.
We do not find it necessary to pass repeated orders particularly when Appeal against order of this Tribunal is pending before the Hon’ble Supreme Court in Civil Appeal Diary No(s).15182/2021, North Delhi Municipal Corporation v. President Dudhela Welfare Association & Anr. Order of this Tribunal has been stayed subject to certain directions. It is however, open to the applicant to move the concerned authorities with particulars of individual violations or take any other remedy as per law.
The Application is disposed of.
