This MA is filed with a prayer to condone the delay in filing of the representation. The applicant has stated reasons in delaying the filing of
representation. We are satisfied with the same and the delay is condoned.
OA No.1887/2019.
This OA is filed challenging the order dated 29.01.2018 passed by the Disciplinary Authority. Through the said order, the respondents have not
extended the benefit of subsistence allowance for the alleged period of deemed suspension.
The applicant was working as Works Manager in the Defence Ministry. He was removed from service through order dated 26.05.2009.
Challenging the same, the applicant filed OA No.126/2011 before the Hyderabad Bench of this Tribunal. The OA was allowed on 19.01.2012. The
order of removal was set aside and the respondents were directed to conduct fresh inquiry and to pass appropriate orders. It is stated that after
conducting the inquiry, the respondents passed order dated 06.04.2016, once again imposing the punishment of removal from service.
Challenging the same, the applicant filed OA No.1201/2015 before the Hyderabad Bench of this Tribunal and the same is pending. Though certain
other proceedings have also ensued, it is not necessary to refer to them.
Once the order of removal from service dated 06.04.2016 is the subject matter of the OA pending before Hyderabad Bench of this Tribunal, it is
essential that the present OA also is clubbed with the same and heard along with that.
Therefore, the present OA is transferred to Hyderabad Bench and shall be heard along with OA No.1201/2015.
