DELIVERED BY HON’BLE MR JUSTICE OM PRAKASH -VII, MEMBER (J)
None present for the petitioner even in the revised call. Shri R.K. Srivastava, learned counsel for the respondents is present.
Referring to Annexure-6 of the compliance affidavit dated 02.01.2019 Shri R.K. Srivastava, learned counsel appearing for the respondents states that direction given by the Tribunal in OA No.802 of 2016 has been fully complied with. Applicant/Petitioner has been reinstated. Entire amount said in the order has already been paid. Thus, the proceedings of the aforesaid contempt are liable to be closed and notices issued are liable to be discharged.
In view of the submissions raised on behalf of learned counsel appearing for the respondents and considering the fact disclosed in the compliance affidavit dated 02.01.2019, we are of the view that substantial compliance has been made of the direction given by the Tribunal. Thus, proceedings of the present contempt are liable to be closed.
Accordingly, the contempt proceedings are closed. Notices issued to the respondents are discharged. All associated MAs stands disposed of.
