1] Heard finally with the consent of the parties.

2] This petition has been filed by the petitioner under Section 482 of Cr.P.C./Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023 for quashment of FIR/charge sheet dated 27/12/2025 bearing Crime No.1031/2025 for the offence punishable under Sections 108 of BNS, 2023 registered at Police Station Vijay Nagar, Indore, District Indore and other consequential proceedings.

3] The allegation against the petitioner is that the deceased Mamta wife of Rahul, present petitioner died by consuming some poisonous substance, which led lodging of the aforesaid FIR by the complainant side.

4] Counsel for the petitioner and respondents No.2 to 4, at the outset have submitted that the parties have already settled the matter out of the Court. Counsel have drawn the attention of this Court to the police station given by the deceased wherein, she has stated that no person is responsible for her death and that she does not want to prosecute the matter, although after this statement, she passed away on 15/11/2025. Counsel has submitted that on account of death of the deceased, her family members lodged the FIR under some misconception, however, the matter has already been settled between the parties and no purpose would be served by keeping the matter pending, the result of which is already decided, and in such circumstances, the petition may be allowed.

5] Counsel for the respondent No.2 to 4 has submitted that he has no objection if the petition is allowed. The respondents No.2 Gopal, respondent No.3 Rajkumar and respondent No.4 Namrita W/o Shubham Yadav also present in the Court, and on a query made by this Court, they have also admitted that they do not wish to prosecute the matter any further.

6] Counsel for the respondent/State, on the other hand, has opposed the prayer.

7] Having considered rival submissions and on perusal of the documents filed on record, and taking note of the fact that the parties have compromised the matter voluntarily without any threat, inducement and coercion, this Court has no hesitation to allow the present petition.

8] Accordingly, the petition is hereby allowed and the FIR/charge sheet dated 27/12/2025 bearing Crime No.1031/2025 for the offence punishable under Sections 108 of BNS, 2023 registered at Police Station Vijay Nagar, Indore, District Indore and other consequential proceedings arising out of the said crime number, are hereby quashed.

9] Accordingly, the petition stands allowed and disposed of.
