By means of the present C482 application, applicants have prayed to quash the cognizance and summoning order dated 06.07.2022 passed by the learned 6th Additional Chief Judicial Magistrate, Dehradun in Criminal Case No.4967 of 2022, State vs. Radha Arya, for the offences punishable under Sections 323, 504 IPC, Police Station Raipur, District Dehradun as well as charge-sheet dated 29.09.2022 in Case Crime/NCR No.4 of 2020.

A joint compounding application has been moved on behalf of the parties seeking to compound the offences under the aforesaid sections along with which the compromise entered into between the parties is also annexed.

Applicant as well as respondent no.2 is present before the Court being identified by their respective counsel.

In the compounding application, it has been stated by the parties that they have reached to terms of compromise wherefor a settlement has also been arrived at between them. It is thus, prayed that the present criminal proceedings be quashed in terms of the compromise arrived at between them.

Learned State Counsel not objected to the compounding application.

The Court interacted with the parties. They fairly stated that they have reached to the terms of compromise.

Since the offences sought to be compounded i.e. 323 and 504 IPC both are compoundable ones and the parties have reached to the terms of compromise, there is no useful purpose to keep the matter pending. Accordingly, the summoning order dated 06.07.2022 passed by the learned 6th Additional Chief Judicial Magistrate, Dehradun in Criminal Case No.4967 of 2022, State vs. Radha Arya, for the offences punishable under Sections 323, 504 IPC, Police Station Raipur, District Dehradun along with entire proceedings of aforesaid criminal case are quashed. Simultaneously, Charge-sheet dated 29.09.2022 in Case Crime/NCR No.4 of 2020 is also quashed.

Present C482 Application stands allowed accordingly.
