W.P.(C) No.11596 of 2022 and I.A. No.6053 of 2022
Mr. Pradhan, learned advocate appears on behalf of petitioners. He submits, his clients are claiming under recorded owners in respect of land acquired by opposite party no.1, for laying pipe line. Compensation determined, according to his client, is Rs. 3,19,000/-. Prayer is for direction for apportionment of the compensation, to include his clients.
Mr. Sharma, learned advocate, Additional Government Advocate appears on behalf of opposite party no.2 and submits, opposite party no.1 is to answer.
On query from Court Mr. Pradhan hands up translation of notice dated 18th October, 2017 issued by the competent authority, on notices mentioned therein. Said notices are not parties. For proper adjudication, Karunakar Bhol and Krushna Chandra Bhol both sons of Gopal Bhol, Mangaraj Bhol son of Dinabandhu Bhol, Ramachandra Bhol and Dolagobinda Bhol both sons of Padan Bhol, Gouranga Bhol son of Mayadhar Bhol, Shankar Bhol and Jayaram Bhol both sons of Chemei bhol and Shiva Bhol son of Sanatan Bhol are all added as parties. Petitioners will file consolidated cause title by tomorrow (28th July, 2022). Thereupon issue notice along with this order upon opposite party no.1 and added opposite parties, by registered/speed post with A.D. Petitioners will put in requisites by 29th July, 2022.
List on 29th August, 2022, as prayed for on behalf of petitioners. In event compensation money has not yet been disbursed, status-quo be maintained till next date. The status-quo will stand vacated on omission by petitioners to file either consolidated cause title or put in requisitions or both, within the times directed.
