Judgment
Cheekati Manavendranath Roy, J
1) Heard learned counsel for the petitioner and learned Government Pleader-III for Services appearing for the respondents.
2) In the Writ Petition No.11037 of 2019, as per order, dated 08.08.2019, this Court has directed the respondents therein to forthwith consider the representation of the petitioner, dated 30.01.2019 and dispose of the said representation by passing appropriate orders to that effect by 19.08.2019 relating to her claim for promotion.
3) Alleging that no such orders are passed on her representation, as directed by this Court, the present Contempt Case is filed by the petitioner.
4) Learned Government Pleader-III for Services appearing for the respondents would submit that as directed by this Court her representation for promotion was considered and an order was passed alleging that her case for promotion could not be considered for the post of HWO, Grade-I (female) as her name was not even included in the separate seniority list under HWOs Grade-II (Female) category maintained in the district, which is yet to be prepared for inclusion in the seniority list of HWO Grade-II (Female) after receipt of orders from the Government.
5) Learned Government Pleader-III for Services has also placed on record a copy of the order passed by the respondents.
6) Thus, it is now evident that the direction of this Court given in the above Writ Petition has been complied with and an order was passed after considering the representation of the petitioner. So, it cannot be said that there is any act of contempt was committed by the respondents.
7) Therefore, the Contempt Case is dismissed. However, if the petitioner feels aggrieved by the order, dated 31.08.2019, passed by the respondents, she is at liberty to challenge the said order in the appropriate forum. No costs.
Consequently, miscellaneous applications, pending if any, shall also stand closed.
