Judgment
This original application under Sections 14 and 15 of National Green Tribunal Act, 2010 (hereinafter referred to as ‘NGT Act, 2010’) has been registered on a letter petition dated 21.07.2022 received from Geethanjali Devapriyan.
Grievance is that a mobile tower is being installed at Plot No. 41 by one Kaja Mohideen. The place is near residence of applicant and despite of objections of applicant, installation of mobile tower has not been stopped. The applicant is apprehensive of health hazards due to toxic waste emanating from mobile tower.
We find that neither installation of mobile tower is an illegal activity per se nor there is any scientific document to show that a mobile tower emanates waves which are detrimental to human health.
In these facts and circumstances, mere installation of mobile tower at a particular place which is owned or in possession of a person installing the tower cannot give rise to any cause of action to maintain this application under Section 14 and 15 of NGT Act, 2010.
The application is accordingly rejected.
