The applicant is an IPS Officer allocated to West Bengal Cadre. Over the period, he was on deputation with CRPF in the rank of DIG.

On a complaint submitted by a lady staff of CRPF, an internal enquiry was held. It is stated that nothing adverse was found against the applicant. Thereafter, he was repatriated to his parent cadre. The applicant states that though his batch mates were promoted to the grade of IG, he was denied promotion.  On the other hand, he was posted as OSD in the rank of SP. This OA is filed claiming reliefs in this regard.

Heard Shri S. K. Gupta, learned counsel for the applicant and Shri Rajeev Kumar, learned counsel for the respondents.

The applicant made a detailed representation dated 24.01.2018 to the Home Secretary, i.e., Respondent No.1 narrating his grievance. It will be only when a speaking order is passed on his representation that occasion would arise for the applicant to approach this Tribunal, if the grievance is not redressed. More than six months have elapsed since the representation has been submitted. The first respondent needs to pass orders on the representation of the applicant, if necessary, by obtaining the view of or remarks from, the state of West Bengal.

We, therefore, dispose of the OA directing that the 1 st respondent shall pass a speaking order on the representation of the applicant dated 24.01.2018 submitted by the applicant, within a period of six weeks from the date of receipt of copy of this order. If any information is sought from the state of West Bengal, the same shall be submitted by them to the 1st respondent without any delay.
