Judgment
It appears that under order dated 12.12.2017 appellants namely, Quadir Khan @ Kadir Khan, Sunny Khan, Pappu Khan, Afzal Khan and
Tansif Khan @ Mithu @ Tansif @ Mitthu Khan were admitted on bail. The prayer for bail of the appellants namely, Belal Khan, Shamshad Khan,
Irshad Khan and Naushad Khan was dismissed as not pressed.
It further appears that due to inadvertence, the name of appellant No.9 Tansif Khan @ Mithu @ Tansif @ Mitthu Khan, who was admitted on
bail has been wrongly typed among the appellants whose prayer for bail was dismissed as not pressed.
Further I.A. No. 9853 of 2017 has been filed for modification of order dated 12.12.2017 passed in cr. Appeal (S.J.) No. 1679 of 2017 to the
extent of the order passed in I.A. No. 7558 of 2017 related with this appellant namely, Tasnif Khan @ Mithu @ Tasnif @ Mitthu Khan as he was
allowed bail by the same order.
Order dated 12.12.2017 passed in I.A. No. 7558 of 2017 and I.A. No. 7554 of 2017 in Cr. Appeal (S.J.) No. 1679 of 2017 is modified to
the extent that the sentence of the appellant No.9, namely, Tansif Khan @ Mithu @ Tansif @ Mitthu Khan is suspended during pendency of the
appeal and he is directed to be released on bail on furnishing bail bond of Rs. 15,000/- (Rupees fifteen thousand) with two sureties of the like
amount each to the satisfaction of the court of Sri Sanjay Kumar No.1, learned Additional Sessions Judge-VIII, Dhanbad or his successor court in
connection with Sessions Trial No. 342 of 2011, subject to the conditions that one of the bailors must be close relative of the appellants. It is
ordered that the appellant No.9 Tansif Khan @ Mithu @ Tansif @ Mitthu Khan will report in the last week of every month before the office
Incharge, Jorapokhar Police Station and if the Officer-in-charge, Jorapokhar, police station find that the appellant is involved in other criminal
activities, the officer-incharge, will report the same to the learned A.P.P so that appropriate order be passed.
Accordingly, I.A. No. 9853 of 2017 stands disposed of.
