The original petition is filed to direct the Court of the IInd Additional District Judge, Thiruvananthapuram, to consider and dispose of A.S.No.8/2020 (Ext P1) within a reasonable time period.
Pursuant to the order dated 23.02.2023 passed by this Court, the learned VIth Additional District Judge(in charge of IInd Additional District Judge), Thiruvananthapuram, by communication dated 24.02.2023, has informed this Court that the appeal stands posted to 20.03.2023 for hearing of the appeal and the interlocutory applications. The learned Judge is holding additional charge of the IInd Additional District Court. The court below requires at least six months’ time to dispose of the appeal.
Heard; Smt.N.N.Girija the learned counsel appearing for the petitioners. Even though notice has been served on the learned counsel appearing for the respondents before the court below and a memo is filed to the effect, there is no appearance for them.
In the light of the pleadings and materials on record and after perusing the communication of the learned District Judge, in exercise of the supervisory powers of this Court under Article 227 of the Constitution of India, I direct the Court of the IInd Additional District Judge, to consider and dispose of A.S.No.8/2020, as expeditiously as possible and in accordance with law, at any rate, within a period of six months from the date of receipt of a certified copy of this judgment.
The original petition is ordered accordingly.
