Judgment
When the matter was called out, nobody appeared for the respondent.
At the joint request made by the learned counsel for the parties, we, on 2982018, directed the parties to appear before the Coordinator of the Supreme Court Mediation Centre on 1592018at 11.00 a.m. However, as per the Mediation Report dated 5102018, mediation has failed as the parties could not arrive at an amicable settlement.
This petition under Section 25 of the Civil Procedure Code, 1908 read with Order XLI of the Supreme Court Rules, 2013 has been filed by the petitioner (wife) for transfer of H.M.O.P. No.25/2017 titled as "Pappu Kumar vs. Puspa Kumari" pending before the Court of Principal Senior Civil Judge, Nellore, Andhra Pradesh to the Court of Principal Judge, Family Court at Patna, Bihar.
After having heard the learned counsel appearing for the petitioner and taking into consideration the grounds taken in the transfer petition, we direct transfer of H.M.O.P. No.25/2017 titled as "Pappu Kumar vs. Puspa Kumari" pending before the Court of Principal Senior Civil Judge, Nellore, Andhra Pradesh to the Court of Principal Judge, Family Court at Patna, Bihar.
Let the record of the case be transferred without delay.
The Transfer Petition is allowed in the aforestated terms.
