Judgment
Impugned in this petition is order No. 27-DE of 2018 dated 10.01.2018 passed by respondent No. 2, whereby the set No. 24, Officer Hostel
Panjtirthi which is claimed by the petitioner to be in her possession as allottee thereof, has been allotted to respondent No. 5. The petitioner has
assailed the order aforesaid inter-alia on the ground that set No. 24, Officer Hostel Panjtirthi, aforesaid has been allotted in her favour and she
continuous to be in possession thereof. It is stated by the learned counsel for the petitioner that the allotment has not been cancelled for, she was
neither put on any show cause notice for cancellation nor any cancellation order was served upon her.
Heard learned counsel for the petitioner.
Considered the submissions made by the learned counsel for the petitioner. Prima-facie the case for indulgence is made out.
Issue notice, returnable within four weeks.
List on 19.02.2018.
In the meantime, subject to objections and till next date of hearing, status quo with regard to set No. set No. 24, Officer Hostel Panjtirthi, as it
exists today, shall be maintained. This order, however, shall not be given effect to, if the cancellation of the allotment of the petitioner has been
done after providing the petitioner an opportunity of being heard.
