The petitioners through instant petition under Articles 226/227 of the Constitution of India are seeking direction to respondents to grant benefit of one notional annual grade increment on completion of one year service in the month of December and October of the respective year.
The petitioners are ex-employees of Punjab Police. They have retired on attaining the age of superannuation. The petitioners are seeking one notional annual grade increment on the ground that they have completed 1 year service in the month of December and October and increment was granted w.e.f. January and November respectively.
Learned counsel for the petitioners submits that grievance of the petitioners, at this stage would be redressed, if respondent is directed to decide their representation/legal notice dated 18.01.2024 (Annexure P-4) in terms of judgment of Supreme Court in ‘DIRECTOR (ADMN AND HR) KPTCL AND OTHERS VS. C.P. MUNDINAMANI AND OTHERS’2023 SCC ONLINE SC 401.

Mr. Aman Dhir, DAG, Punjab, who on advance notice is present in Court, accepts notice on behalf of respondents-State.
With the consent of both sides, the matter is taken up for final disposal.
Learned counsel for the respondent asserts that he has no objection, if petition is disposed of with a direction to respondent to decide legal notice of the petitioners in a time bound manner and in view of judgment of Supreme Court in C.P. MUNDINAMANI AND OTHERS (supra).
In the wake of statement of both sides, the present petition stands disposed of with a direction to respondent to decide claim of the petitioners within 3 months from today. The Competent Authority is expected to consider judgment of Supreme Court in C.P. MUNDINAMANI AND OTHERS (supra) while adjudicating claim of the petitioners.
