The present writ petition has been filed under Articles 226/227 of the Constitution of India seeking issuance of a writ in the nature of MANDAMUS directing the respondents to grant one notional annual increment to the petitioners, who were entitled for grant of annual increment on 1st July of the respective year and who retired prior to 1st July of the respective year and had completed more than 6 months of service, has not been granted annual increment and also to grant one notional annual increment on proportionate basis and thereupon revise/re-fix the pension along with all consequential benefits
Learned counsel for the petitioners submitted that the petitioners had served a legal notice dated 29.01.2024 (Annexure P-6) to the respondent-UHBVNL but the same has not been considered and decided till date. He further submitted that at this stage, the petitioners will be satisfied in case the aforesaid legal notice dated 29.01.2024 (Annexure P-6) is considered and decided by respondent-UHBVNL in accordance with law and in a time bound manner.
Notice of motion.
On the asking of the Court, Mr. Samarth Sagar, Addl. A. G., Haryana, accepts notice on behalf of all the respondents. He submitted that in view of the limited prayer made by learned counsel for the petitioners, he has no objection in case a time bound direction is issued in this regard.
In view of the aforesaid facts and circumstances, without calling for the reply from the respondents and without expressing anything on the merits of the case, the present writ petition is disposed of with a direction to respondent No.2-Managing Director, UHBVNL, Panchkula/Competent Authority to consider and decide the legal notice dated 29.01.2024 (Annexure P-6) in the light of judgment of Hon’ble Supreme Court in Civil Appeal No.2471 of 2023, titled as The Director (Admn. and HR) KPTCL and others versus C. P. Mundinamani and others, decided on 11.04.2023, strictly in accordance with law and within a period of three months from today.
