Since these two bail applications arise out of one and same case record, the same are heard together and disposed of by this common order with the consent of the learned counsel for the parties.
These are the bail applications U/S.483 of BNSS by the petitioners for grant of bail in connection with Maidalpur PS Case No.23 of 2026 corresponding to GR Case No.248 of 2026 pending in the file of learned SDJM, Nabarangpur, for commission of offences punishable U/Ss.310(4)/310(5)/111(4) of BNS r/w Section 27 of Arms Act, on the main allegation of committing organized crime by congregating in an isolated place, along with co-accused persons being armed with lethal weapons and preparing to commit dacoity.
Heard, Mr. Rajib Lochan Pattnaik, learned counsel for the petitioner in BLAPL No.6934 of 2026; Mr. Basudev Mishra, learned counsel for the petitioner in BLAPL No.7775 of 2026 and Mr. P. Satpathy, learned Additional Public Prosecutor in the matter and perused the record.
After having considered the rival submissions and taking into consideration the nature and gravity of the offences as alleged against the petitioners vis-‡-vis the accusations sought to be brought against them and regard being had to the pre-trial detention of the petitioner in custody since 28.02.2026 with submission of charge sheet in the meantime and taking into account the other circumstances on record in entirety including the inherent right of the accused-petitioners to be presumed innocent until proven guilty at the trial and the mode & manner of implication of the petitioners in this case with grant of bail to co-accused Urdhaba Harijan in BLAPL No.3120 of 2026, this Court without expressing any view on merit admits each of the petitioners to bail.
Hence, these two bail applications of the petitioners namely Purusottam Mali & Ajay Mali (In BLAPL No.6934 of 2026) and Hensen Dhoba & Phabit Bagh (In BLAPL No.7775 of 2026) are allowed and each of the petitioners is allowed to go on bail on furnishing bail bonds of Rs.25,000/- (Rupees Twenty-Five Thousand) with one solvent surety for the like amount to the satisfaction of the learned Court in seisin of the case on such terms and conditions as deem fit and proper by it with following condition:-
the petitioners shall report attendance before the jurisdictional Police Station once in a fortnight preferably on a Sunday in each month in between 10 A.M. to 12 Noon for three(03) months from the actual date of release from the custody.
The I.I.C. of Jurisdictional Police Station shall not detain the petitioner unnecessarily after recording his attendance beyond the time as stipulated.
Accordingly, these BLAPLs stand disposed of. A soft copy of this order be immediately communicated to the concerned Court, who shall afterwards communicate the same to the concerned Jail through e-mail for reference.
