These are bail applications U/S.483 of BNSS by the petitioners for grant of bail in connection with Krushnaprasad P.S. Case No. 69 of 2026 arising out of G.R. Case No. 262 of 2026 pending in the Court of learned JMFC-I (Cog. Taking), Puri, for commission of offence punishable U/Ss.61(2)/115(2)/118(2)/109/312 of BNS r/w. Sec.25/27 of Arms Act, on the main allegation of attempting to commit robbery by firing at the rider of the scooty, along with co-accused persons.
Heard, Mr. Sukanta Kumar Dalai, learned counsel for the petitioner in BLAPL No. 6312 of 2026; Mr. Himanshu Bhusan Dash, learned counsel for the petitioner in BLAPL No. 6144 of 2026, Mr. Mihir Sahoo, learned counsel for the petitioner in BLAPL No. 6374 of 2026; Mr. Subhasish Satapathy, learned counsel for the petitioner in BLAPL No. 7887 of 2026; Mr. Bhabani Sankar Das, learned counsel for the petitioner in BLAPL No. 8105 of 2026; Mr. Lalatendu Samantaray, learned Senior Counsel, who is being assisted by Mr. Jitendra Samantaray, learned counsel for the petitioner in BLAPL No. 8189 of 2026 and Mr. S.C. Pradhan, learned Addl. PP in these matters and perused the record.
After having considered the rival submissions upon perusal of record, it appears that the FIR has been registered against unknown persons, but no TI parade has been conducted to identify the suspects. Besides, none of the petitioners except the petitioner-Bapi @ Samanta Gopabandhu Ransingh is having any criminal antecedents, however, even if the said petitioner-Bapi @ Samanta Gopabandhu Ransingh is considered, he is stated to be involved in three criminal cases, but he has disclosed it in his bail application. Besides, the petitioners are in custody for some time and in the meantime, charge sheet has already been submitted.
In view of the aforesaid facts and circumstances and taking into consideration the nature and gravity of the offences as alleged against the petitioners vis-‡-vis the accusations sought to be brought against them and regard being had to the mode and manner of implication of the present petitioners and keeping in view the other circumstances on record in entirety including the inherent right of the accused-petitioner to be presumed innocent until proven guilty at the trial, this Court without expressing any view on merit, admits each of the petitioners to bail.
Hence, these six bail applications of the petitioners namely Bidya @ Bidyadhar Jena (BLAPL No. 6312 of 2026); Bibek @ Bibekananda Bishoyee (BLAPL No. 6144 of 2026); Bapi @ Samanta Gopabandhu Ransingh (BLAPL No. 6374 of 2026); Aashit Pradhan (BLAPL No. 7887 of 2026); Kalu @ Kumar Pradhan (BLAPL No. 8105 of 2026) and Shiba @ Jyoti Krushna Pattanaik (BLAPL No. 8189 of 2026) stand allowed and each of the petitioners are allowed to go on bail on furnishing bail bonds of Rs.50,000/- (Rupees Fifty Thousand) each with one solvent surety for the like amount to the satisfaction of the learned Court in seisin of the case on such terms and conditions as deem fit and proper by it with following condition-
(i)the petitioner- Bapi @ Samanta Gopabandhu Ransingh shall report attendance before the jurisdictional Police Station once in a fortnight preferably on a Sunday in each month in between 10 A.M. to 12 Noon for three(03) months from the actual date of release from the custody.
(ii)all the petitioners shall cooperate with the trial.
The I.I.C. of Jurisdictional Police Station shall not detain the petitioner- Bapi @ Samanta Gopabandhu Ransingh unnecessarily after recording his attendance beyond the time as stipulated.
Accordingly, these BLAPLs stand disposed of. Issue urgent certified copy of the order as per Rules. A soft copy of this order be immediately communicated to the concerned Court, who shall afterwards communicate the same to the concerned Jail through e-mail for reference.
