Heard Mr. Mahesh Tewari, learned counsel for the petitioner, Mr. Bhaskar Trivedi, learned counsel for the respondent-State and Ms. Prachi Pradipti, learned counsel for respondent nos. 2 and 3.
This criminal writ petition has been taken through Video Conferencing in view of the guidelines of the High Court taking into account the situation arising due to COVID-19 pandemic.
I.A. No.206 of 2020 has been filed for extension of interim order dated 05.09.2018.
Mr. Tewari, learned counsel for the petitioner submits that the concerned court has already vacated the stay in light of the judgment passed by the Hon'ble Supreme Court in the case of Asian Resurfacing of Road Agency Private Ltd. and another v. Central Bureau of Investigation, reported in (2018) 16 SCC 299. He further submits that this I.A. was not listed earlier although it has been filed for extension of interim order.
Since the case is still pending before the concerned court and this matter is also pending before this Court, it is desirable that the interim order will be extended.
In view of the above facts, interim order dated 05.09.2018 is extended, till the next date.
Accordingly, I.A. No. 206 of 2020 stands allowed and disposed of.
