Challenging the action of the respondent No.4 in freezing the petitioner's saving bank account bearing No.911010029855980, Axis Bank Limited, Dahod Branch, Gujarat, pursuant to the directions given by respondent No.3 allegedly in connection with Crime No.1368/2025, registered at Cyber Crime Police Station, Rachakonda, this writ petition has been filed.

The learned counsel for the petitioner has drawn the attention of this Court to the communication sent by Axis Bank to the petitioner through e-mail, stating that there is a lien marked on the petitioner's bank account xxxxxxxx5980, based on the complaint received from the National Cybercrime Reporting Portal (NCRP) and the transaction amount was Rs.19,600/- and that the petitioner was requested to contact concerned police station/investigation officer to pursue the NCRP complaint for removal of the lien marked on the account.

The learned counsel for the petitioner, however submitted that in spite of limiting the lien amount to Rs.19,600/-, the respondents are not permitting the petitioner to operate the bank account with regard to the balance amount, therefore, this writ petition has been filed.

The learned Assistant Government Pleader for Home, on written instructions, submitted that respondent No.3 has not issued any direction to freeze the petitioner's bank account and that the account was frozen through the NCRP mechanism and not pursuant to any order issued by respondent No.3. It is further submitted that if the petitioner approaches respondent No.3 by submitting a representation along with the relevant documents, the same will be examined in accordance with law and appropriate action, including issuance of necessary communication to the Nodal Officer of Axis Bank Limited for continuation of the lien over the disputed amount and defreezing the remaining balance in the account, shall be taken.

In view of the above submissions, this Court finds that the lien on the petitioner's bank account is only to the extent of disputed amount i.e., Rs.19,600/- and for removing such lien, the petitioner has to approach respondent No.3 with an appropriate reply. Therefore, this Court deems it fit and proper to direct the petitioner to submit his reply to respondent No.3 within a period of ten (10) days from today and on receipt of such reply, the respondent No.3 shall consider the same and pass appropriate orders thereon.

Accordingly, the writ petition is disposed of. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this writ petition, shall stand closed.
