In this petition, the prayer has been made for issuing direction upon the respondent authorities to recognize the petitioner as Village Headman (Gram Pradhan) of Village -Jambani of Khadida Gram Panchayat.
The learned counsel for the petitioner submits that authority concerned has recognized the respondent no.6- Baijnath Mahakund as Village Headman (Gram Pradhan) of Village -Jambani of Khadida Gram Panchayat, whereas in terms of the precedent the petitioner can only be Village Headman (Gram Pradhan) as his father was earlier Village Headman (Gram Pradhan).
The learned counsel for the respondent State submits that this petition is misconceived one and she submits that the writ petition is need to be dismissed as the respondent no.6 was appointed in the year 2018. She submits that if such dispute is there, the Deputy Commissioner of the concerned District is the correct authority.
In view of above and considering that the dispute can be decided only by the concerned Deputy Commissioner as such this petition is being disposed of, without interfering into the merits of the case and the claim of the petitioner with consent of the parties, by giving opportunity to the petitioner to file a fresh representation before the Deputy Commissioner, East Singhbhum, who on receipt /production of a copy of this order, will conduct an enquiry and after providing due opportunity to the parties, shall take appropriate decision in the matter in accordance with law, preferably within four months from the date of receipt/ production of a copy of this order.
This petition is accordingly disposed of.
Pending petition if any also stands disposed of accordingly.
