Judgment

This matter is taken up through hybrid mode.
Heard learned counsel for the Petitioner and learned Addl. Standing Counsel for the State.
The Petitioner is in custody since 23.4.2024 in connection with Khandagiri P.S. case No-253/2024, corresponding to C.T. Case No.629/2024, pending before the Court of learned J.M.F.C.(V),Bhubaneswar; for the alleged commission of the offence under Sections 392/411/413/482/34 of I.P.C. It is alleged that the petitioner and another person were selling Android Smart Mobile Phones at a very low price which aroused suspicion that the mobiles were stolen. On being detained by Police and on personal search being carried out, several incriminating articles including mobile phones and gold chains etc. were recovered from them. There is however, no specific evidence to show that the mobile phones were stolen.
Taking into consideration all the above facts and the materials on record, I am inclined to allow the prayer for bail. Let the Petitioner be released on bail on such terms and conditions as may be imposed by the Court in seisin over the matter in the aforesaid case.
The BLAPL is disposed of.
Urgent certified copy of this order be granted on proper application.
