Judgment

This matter is taken up through hybrid mode.
Heard learned counsel for the Petitioner and learned counsel for the State.
The Petitioner is in custody since 23.4.2024 in connection with Khandagiri P.S. case No-253/2024, corresponding to C.T. Case No.629/2024, pending before the Court of learned J.M.F.C.(V),Bhubaneswar; for the alleged commission of the offence under Sections 392/411/413/482/34 of I.P.C.
It is alleged that the petitioner and another person were selling Android Smart Mobile Phones at a very low price which aroused suspicion that the mobiles were stolen. On being detained by Police and on personal search being carried out, several incriminating articles including mobile phones and gold chains etc. were recovered from them. There is however, no specific evidence to show that the mobile phones were stolen.
Taking into consideration all the above facts and the materials on record, I am inclined to allow the prayer for bail. Let the Petitioner be released on bail on such terms and conditions as the court below may deem fit and proper to impose including the following conditions:-
i. He shall appear before the IIC of Khandagiri Police Station on every Sunday at 10.00 A.M. for a period of six months and such fact shall be certified by the IIC to the concerned Court once a month.
(ii) He shall personally appear before the Court below on each date of posting of the case and no representation through counsel shall be allowed under any circumstances.
The BLAPL is accordingly disposed of.
Issue urgent certified copy as per rules.
