It appears that a show-cause notice dated 01.01.2021 has been issued against the petitioner under section 37 of the Gujarat Municipalities Act, 1963 for removal of the petitioner as a President of the Kheda Nagarpalika.
Mr. Hari Patel, learned advocate appearing for the petitioner would submit that though an affidavit in reply of the State submits that the petitioner was heard and written submissions were filed on 16.09.2021 and an additional reply on 23.09.2021, in fact she was not heard. He would rely on the rojkam of the authorities in this regard.
Mr. Meet Thakkar, learned AGP submits that the reply was filed by the petitioner. The present petition has been filed submitting that since removal is initiated at the behest of respondent no. 2 against whom a separate complaint has been made, it is the case of the petitioner that the proceedings of that complaint be clubbed with the proceedings pending before the authority in context of his removal.
Having heard learned advocates for the parties, it appears that by way of the present petition the petitioner wants to stall passing of an order pursuant to which hearing has taken place before the authorities. The respondents are directed to pass appropriate order in accordance with law. Liberty is reserved to the petitioner to challenge the same including taking/raising all contentions raised in the present petition at the time when appropriate final order is passed in the proceedings against removal of the petitioner if thought so fit.
With the above observations, petition is disposed of. Notice is discharged.
