The present petition has been filed under Articles 226/227 of the Constitution of India seeking a writ in the nature of MANDAMUS directing the respondent-Corporation to treat the petitioners at par with the reinstated employees who have been now reinstated on daily wages basis at DC rates and to treat them as employees under the outsourcing /contractual agency.

At the outset, Mr. Padamkant Dwivedi, Advocate appearing on behalf of respondents No.2 and 3 has stated that similarly situated persons had also filed a petition before this Court in CWP No.13193 of 2018, titled Ashok Kumar and others Vs. State of Haryana and others and the same has been disposed of on the ground that the petitioners were deployed through Haryana Kaushal Rozgar Nigam Limited and there was no move to replace them at present. He submitted that so far as the petitioners of the present case are concerned, he has instructions to state that there is no move to replace them at present as well and they are also working through the aforesaid Nigam.

Mr. Sajan, Advocate appearing on behalf of the petitioners and Mr. Padamkant Dwivedi, Advocate appearing on behalf of respondents No.2 and 3 have submitted that the present petition can be disposed of in terms of the aforesaid order dated 07.12.2022 passed in CWP No.13193 of 2018.

In view of the above, the present petition is disposed of in the same terms as that of the aforesaid petition i.e. CWP No.13193 of 2018.
