Priyal Shrivastava vs Central Board of Secondary Education and Another

In pursuance to the directions issued on the last date, Shri Rajesh Maindiretta has produced an answer-sheet no. 130225226 with regard to the petitioner having roll no. 84528606. Records indicate that petitioner was a candidate who had appeared in the Joint Entrance Examination (JEE) conducted by the Central Board of Secondary Education for admission to IITs and ISM Dhanbad. According to the petitioner, when she saw the result, it transpired that she has obtained 3 marks in the paper of Mathematics whereas according to her estimate, she had answered all the 30 questions and she was expecting more marks.

By pointing out that she has a brilliant academic career, even in the 12th Board examination, she has obtained more than 95 % marks and contending that her answer-sheet in the JEE has not been properly valued, this writ petition is filed.

To examine the grievance of the petitioner, Shri Rajesh Maindiretta as directed by this Court on the last date has produced the answer-sheet which is the OMR sheet along with the tabulation of the questions, marks allotted to the petitioner and total marks received. From the answer-book of the petitioner produced by the respondents, it is seen that in Physics, petitioner has answered 10 questions correctly and 10 questions wrongly and after evaluating the same in accordance with the rules, she has been awarded 30 marks in the subject of physics. Similarly, in the subject of Chemistry, petitioner answered 20 questions correctly and answered 4 questions incorrectly and, therefore, she has obtained 76 marks whereas in the subject of Mathematics, petitioner has answered 4 questions correctly and 13 questions wrongly and, therefore, she has been awarded 3 marks. In all, petitioner has been awarded 109 marks.

From the submissions made by Shri Rajesh Maindiretta, it is seen that the last candidate who is qualified to appear in the final examination namely the Advance Examination has got 113 marks and petitioner is not qualified to appear in the advance examination.

On a perusal of the OMR sheet of the petitioner, we find no error in evaluation of marks of the petitioner. That being so, we are not inclined to interfere into the matter. However, if petitioner has any grievance with regard to the manner in which the valuation has been done in the answer-sheet, she is granted liberty to represent to the respondents in accordance with law and agitate her grievance. Accordingly, finding no ground to interfere into the petitioner, the petition is dismissed on the grounds indicated hereinabove.
