Judgment

Petitioner has approached this Court with a prayer for quashing the performance report for Individual Development of Exclusive (PRIDE) for the year 2015-16 at Anenxure-4 whereby 'Rating-2' has been given to the petitioner under the heading of process- "Coal Production Achievement % and under the heading Financial- 'Profit Variance per tonne. Petitioner has further prayed for quashing of grade "Good" given under Final Rating and for direction upon the respondents to review and rate the petitioner under aforesaid heads as '5' in place of '2' as per company MOU and grant final rating Grade at par with previous years i.e., 'Excellent' and above instead of 'Good'.
Further prayer has been made for grant of performance related pay as applicable to employees graded as excellent and above in final rating.
At the very out set, it has been submitted by the learned counsel for the petitioner that already the petitioner has preferred representation before the Director (Personal) Coal India Ltd., on 14.09.2017 for redressed of his grievances but no decision has been taken as yet.
Mr. A. K. Mehta, learned counsel appearing on behalf of respondents submits that though he is not ready but if petitioner files a fresh representation to C.M.D. Coal India giving all details, the same shall be considered in accordance with law.
In view of the submissions of the parties, petitioner is directed to file a fresh representation within a period of two weeks from the date of receipt of a copy of this order before Chief Managing Director, Coal India, Kolkata, and if such representation is filed, the same shall be considered in accordance with law. C.M.D/competent authority is directed to dispose of the representation with a reasoned order within a further period of eight weeks.
Let it be made clear that this Court has not entered into merits of the case. Before passing the final order the petitioner, if required, shall be heard personally after issuing notice to him.
This writ petition stands disposed of.
