PER HON’BLE MR. PANKAJ KUMAR, MEMBER (A)

In this case relating to reinstatement, the applicant has sought the following reliefs:

i.

To reinstate the applicant in service as no review of suspension has ever taken place with all consequential benefits.

ii.

To pay the applicant subsistence allowance from the date of when he was placed under suspension i.e. 11.09.2015 till such time, the suspension order was valid (90 days from the date of passing of suspension order i.e. 28.02.2018).

iii.

To pay salary for the remaining period till the date the applicant is reinstated back in service after declaring suspension order invalid in the shape of arrears alongwith interest 12% pa from the date of due till the actual date of payment.

iv.

Any other relief, which this Hon'ble Tribunal may deem fit, just and proper under the circumstances of the case, may also be passed.

Cost of the present case.

Heard learned counsel for the applicant, learned counsel for the respondents and perused the records.

In this OA, the applicant has challenged the order of suspension dated 28.02.2018.

Learned counsel for the applicant submits that in the meantime the respondents have passed the punishment order dated 05.03.2026 against which the applicant has filed an appeal dated 31.03.2026 and the interest of justice would be served if the present OA is disposed of directing the respondents to dispose of the applicant’s pending appeal within a reasonable period of time.

Learned counsel for the respondents opposes the aforesaid prayer; however, submit that, if so directed, at least two months’ time may be given for disposal of the said representation/appeal.

Keeping in view the innocuous prayer made by the applicant, this O.A. is disposed of, without going into the merits of the case, with a direction to the respondents/competent authority to consider and dispose of the pending appeal dated 31.03.2026 of the applicant as per law by way of reasoned and speaking order to be communicated to the applicant within two months from the date of receipt of certified copy of this order.

Associated MAs, if any, also stand disposed of.

Parties shall bear their own costs.
