Judgment
Per:Hon’ble Mr. R.N. Singh, Member (J)
In the present OA filed under Section 19 of the Administrative Tribunals Act, 1985, the applicant has prayed for the following reliefs:
“(i)By an order or direction, quash and set aside the order dated 19.05.2025 at ANNEXURE-A-1 to this Original Application passed by the Respondent No. 3 Employer, The Divisional Railway Manager, DRM Office, Central Railways, Pune;
(ii). By way of an interim order direct the respondent No. I to 3 not to terminate the services of the Applicant, during the pendency of the instant Original Application;
(iii). During the pendency of the instant Original Application, stay the effect, operation, implementation and execution of the order dated 19.05.2025 at ANNEXURE-A-1 to this Original Application passed by the Respondent No. 3 Employer, The Divisional Railway Manager, DRM Office, Central Railways, Pune;
(iv). Allow the application with costs;
(v). Grant any other relief which this Hon'ble Tribunal may deem fit and proper in the facts and circumstances of the case.”
The impugned order dated 19.05.2025 reads as under:
“File No. CR-PADPERS (WELF) 97/2022-0/0 SR DPO/PA/CR Central Railway Divisional office Personnel Branch, Pune Date: 19/05/2025 No:PA/P/RP-Cell/Caste/ST/Veri Ch:OS(P)/Comml, Optg, Engg. & C&W Pune Subject: Validation of Caste Certificate Reg. Ref: HQ's L. No. CR/HQ/OPERS/PRPP/4/2022Datep14.05.2025 As per above HQ's letter, the caste certificates of following ST employees has to be get validated from Caste Certificate Validity Authority.

In case, if any caste certificate is not get validated, concerned Branch Officer may please be requested to take the said staff under DAR as per Para 6.1 of Railway Board's letter No. 2025-E(SCT)1/25/1 dated 09.05.2025; Copy of the letter enclosed).”
After arguing for some time, learned counsel for the applicant seeks permission to withdraw the present OA with liberty to the applicant to agitate his grievances, if any, afresh based on developments subsequent to the impugned order.
Permission sought is granted. The OA stands dismissed as withdrawn with liberty as aforesaid. No costs.
