This application has been filed for quashing of the entire criminal proceedings of Chandankiyari P.S. Case No. 52 of 2020 for the offences under sections 420 and 34 of the Indian Penal Code, which is pending before the court of Ms. Samirah Khan, learned Judicial Magistrate, Bokaro.
Case of the opposite party no. 2 is that the Informant Mukesh Kumar Mahatha made a search on Google for running a Customer Service Centre and submitted an on-line application on Digital World CSP. On 07.03.2020 one application form was sent on his mail id and he was directed to submit the application after filling the form along with the registration fee of Rs. 11,800/- in the account number 38655490714, IFSC Code SBIN0001719 in two installments. The Informant complied with the said direction. The Informant, as directed, twice deposited Rs. 25,000/- and once Rs. 23,500/- in the aforesaid account. He had received direction for depositing the money by mobile phones nos. 8585007356, 8670202691, 8697694924 and 8585007412. Later on, the accused persons decamped away with the deposited amount. The Informant tried to contact the bearers of the aforesaid mobile numbers, but they stopped receiving his call.
From perusal of the record, it appears that the petitioner was the bearer of one of the mobile numbers which was used in cheating the Informant.
Considering the aforesaid facts, prima facie case under sections 420 and 34 of the Indian Penal Code is made out against the petitioner. No case for quashing of the entire criminal proceedings in connection with Chandankiyari P.S. Case No. 52 of 2020 is made out. Accordingly, this criminal miscellaneous petition is dismissed. Pending I.A., if any, also stands disposed of.
