Judgment
This is an application for anticipatory bail moved under Section 438 of the Code of Criminal Procedure.
The petitioner is the second accused in Crime No.1082 of 2020 of Melparamba Police Station registered for offences punishable under Sections
341, 294(b), 324, 506(ii) and 308 of the Indian Penal Code.
The allegation is that when the wife of the first accused along with the de facto complainant went to the house of the first accused on 15.11.2020 at
09.00pm, the accused abused them in filthy language; the allegation against the second accused is that he attacked the de facto complainant by
inflicting a stab injury on the abdomen and had used a knife for the alleged attack.
Heard the learned counsel for the petitioner and the learned Public Prosecutor.
After hearing the counsel on both sides, I am not inclined to grant pre-arrest bail to the petitioner.
But the petitioner is at liberty to surrender before the investigating officer within ten days from today, in that event, after making interrogation and
arrest, if necessary, he shall be produced before the court and then he can move for regular bail before the Jurisdictional Magistrate; thereafter, the
application shall be promptly considered, as per law.
Subject to the above, the application is dismissed.
